Please read these terms carefully before placing a wholesale order. By submitting an order or payment to QQ VAPE, you confirm that you have read, understood, and agreed to the terms below.
1. Scope of Supply
QQ VAPE (operated by Leo, contact: [email protected]) supplies empty, unfilled vape pod hardware through the website qqvape.com. All products listed are:
- Sold strictly as empty hardware components — no substance of any kind is included
- Intended for use by licensed B2B buyers operating in regulated or permitted jurisdictions
- Not sold to retail consumers or minors under any circumstances
These Terms govern all transactions conducted via qqvape.com, WhatsApp, or email correspondence with QQ VAPE.
2. Product Disclaimer & Buyer Responsibility
QQ VAPE supplies hardware only. Our products contain no nicotine, cannabis, CBD, HHC, or any controlled or regulated substance. We are a hardware manufacturer and supplier — not a substance producer, distributor, or licensed cannabis operator.
The buyer assumes full and sole legal responsibility for all activities performed after the hardware leaves our facility, including but not limited to: substance filling, product labelling, regulatory compliance, import licensing, customs clearance, and end-consumer distribution.
Any legal action, fine, seizure, or regulatory consequence arising from the buyer’s use of our hardware in their jurisdiction is entirely the buyer’s liability. QQ VAPE accepts no responsibility whatsoever for the downstream use of supplied hardware.
By placing an order, the buyer warrants that:
- They hold all licences, permits, and regulatory approvals required to import, fill, and distribute vape hardware products in their operating jurisdiction
- The substances they intend to fill into the hardware comply with all applicable laws in their country or region
- They will not resell our hardware to minors or use it in any application prohibited by local law
3. Buyer Eligibility
Orders are accepted from registered businesses only. By placing an order you confirm that you are acting on behalf of a legally registered company or sole trader, and not as a retail consumer. QQ VAPE reserves the right to request company registration documents before processing any order.
We do not knowingly supply to buyers in jurisdictions where the import or possession of vaping hardware is fully prohibited. It is the buyer’s responsibility to verify legality before ordering.
4. Order Confirmation & Payment
An order is confirmed only after:
- Written agreement on product SKUs, quantities, unit price, and delivery terms via WhatsApp or email
- Receipt of the required deposit or full payment as agreed in writing
Payment terms vary by order type:
Standard In-Stock Pod Cartridges — catalog SKUs held in inventory, dispatched promptly:
- 100% prepayment required before shipment is released
- Typically ships within 3–5 business days of payment receipt
Custom Pod Cartridges — any cartridge order involving custom colour, logo, coil specification, or packaging requires a production run:
- 30% deposit required to commence production
- 70% balance due before shipment is released
- Production lead time: 7–10 business days after deposit receipt
Pod Systems / Vape Devices — all device orders are made to order:
- 30% deposit required to commence production
- 70% balance due before shipment is released
- Production lead time: 7–10 business days after deposit receipt
Accepted payment methods: Bank Transfer (SWIFT / SEPA) and USDT (TRC-20). All prices are quoted in USD unless otherwise agreed in writing. QQ VAPE is not liable for exchange rate fluctuations between quotation and payment.
5. Pricing & Quotation Validity
All prices quoted via WhatsApp, email, or on the website are valid for 7 calendar days from the date of quotation unless otherwise stated. Prices are subject to change based on raw material costs, production scheduling, and order volume. A confirmed and paid order locks the agreed unit price for that production run only.
6. Shipping, Risk & Title
Unless otherwise agreed in writing, all shipments are dispatched on EXW (Ex Works) terms from our production facility. Risk and title pass to the buyer upon handover to the buyer’s nominated freight forwarder or carrier.
- Dispatch timeline: standard in-stock cartridges ship within 3–5 business days of payment; custom cartridges and pod systems ship within 7–10 business days of deposit receipt
- QQ VAPE is not responsible for delays caused by customs inspection, freight forwarder errors, force majeure events, or destination country import restrictions
- The buyer is responsible for all import duties, VAT, customs brokerage fees, and destination country compliance at the point of entry
7. Intellectual Property
All product designs, specifications, technical drawings, and branding materials provided by QQ VAPE remain the intellectual property of QQ VAPE or its manufacturing partners. Buyers may not reproduce, reverse-engineer, or sub-license product designs without prior written consent.
For OEM/custom orders: any buyer-supplied artwork, logos, or design files remain the intellectual property of the buyer. QQ VAPE will not use buyer-supplied designs for any other customer’s orders.
8. Limitation of Liability
To the maximum extent permitted by applicable law, QQ VAPE’s total liability for any claim arising from a transaction shall not exceed the invoice value of the specific order to which the claim relates.
QQ VAPE is not liable for:
- Loss of revenue, loss of profit, or consequential damages of any kind
- Regulatory penalties or legal costs incurred by the buyer in their jurisdiction
- Damage arising from the buyer’s filling, capping, labelling, or distribution activities
- Any claim submitted beyond 30 days of confirmed delivery
9. Governing Law & Dispute Resolution
These Terms are governed by the laws of the People’s Republic of China. In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation. If no resolution is reached within 30 days, disputes shall be submitted to the competent court or arbitration body in Dongguan, China.
10. Amendments
QQ VAPE reserves the right to update these Terms at any time. The current version is always published at qqvape.com/terms-and-conditions/. Continued use of our services after an update constitutes acceptance of the revised Terms.
